FAMSCA Training Session: Terms and Conditions

These terms apply to every FAMSCA workshop. By completing your registration, you confirm that you have read these terms, that you understand them, and that you agree to them.

A Spanish translation of these terms is provided for convenience. The English version governs and controls in the event of any discrepancy.

1. About the class

FAMSCA workshops are two-day, hands-on, in-person classes. They are held at 46 Traynor St, Units 1 and 2, Hayward, CA 94544. There is no remote or online attendance option.

Each class is limited to a maximum of 12 students so that every student gets hands-on time and direct instruction.

Class dates are set by FAMSCA and are posted before you enroll. Dates can change. See Section 5.

2. Registration

Register through the FAMSCA website. You select the class you want and complete payment to hold your seat. Your seat is not held until payment is received.

A seat is held in the name of the student who will attend. Tell us before the class if a different person will be attending in your place.

3. Payment

Tuition is the amount in effect at the time you register, as shown at checkout. Full payment is required to hold a seat.

FAMSCA does not accept payment on arrival. If you have not paid before the class, you do not have a seat.

4. Minimum enrollment and deadlines

A class runs with at least 4 students. Enrollment is reviewed seven days before the class. At that point, FAMSCA counts the students who have paid tuition in full. If there are fewer than four, FAMSCA may cancel or reschedule the class.

Registration stays open until two days before the class, subject to available seats.

5. If FAMSCA cancels or reschedules a class

If a date changes, or if a class does not reach four students and is cancelled, FAMSCA contacts every student who has paid, personally, before any automated message goes out.

You then choose one of two things:

Your seat in the next class, at no additional cost, or

A credit toward a future FAMSCA class.

A credit is not a refund. Credits are applied to a future FAMSCA class and are not redeemable for cash. A credit expires one year from the date it is issued.

When FAMSCA cancels a class, that class stops being available for purchase immediately.

6. If you cannot attend

If you contact FAMSCA before your class begins, your seat moves to the next scheduled class with seats available, at no additional cost. There is no notice requirement: any time before the class begins counts. A moved seat counts toward the 12-student limit in the class it joins.

A seat may be moved this way up to three times. If you cannot attend after the third move, your tuition is forfeited.

If you do not attend and did not contact FAMSCA, you may claim a seat in one later class. You must contact FAMSCA within 30 days of the class you missed to claim it. A missed class does not automatically reserve a seat in a later one, and if you do not claim it within those 30 days, your tuition is forfeited.

These two provisions do not combine. If your seat has already been moved at your request, failing to attend without contacting FAMSCA forfeits your tuition.

Tuition is not refunded under this section. Moving your seat is the remedy.

7. Waitlist

If a class reaches 12 students, FAMSCA may keep a list of people who want to be told if a seat opens. Being on that list does not hold a seat.

8. Certificate

A certificate of completion is issued to students who attend both days of the class.

A student who attends only one day does not receive a certificate and is not entitled to attend a later class to make up the day he missed.

9. Safety, equipment, and assumption of risk

FAMSCA workshops involve hands-on work with power tools, grinders, chemical coatings, and related equipment. This work carries risk of injury.

By registering, you confirm the following:

You understand that the class includes hands-on activities and that those activities carry risk.

You will wear the personal protective equipment required for each activity. PPE is provided and its use is mandatory where FAMSCA says it is.

You will follow all safety instructions and protocols given by the instructor.

You will use all tools and equipment correctly and safely.

You accept full responsibility for your own safety during the class.

FAMSCA may remove any student from a class for unsafe conduct or for refusing to follow safety instructions. Tuition is not refunded in that case.

10. Changes to these terms

FAMSCA may update these terms. The terms that apply to you are the ones in effect on the date you registered.

11. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Any dispute arising out of or relating to these terms or to a FAMSCA workshop will be brought in the state or federal courts located in Alameda County, California, and you agree to the jurisdiction of those courts.

Nothing in this section prevents either you or FAMSCA from bringing a claim in small claims court, where the claim qualifies for that court.
